Terms of use and sale

These terms govern Decktype use and the Pro and Autonomous subscriptions offered by KAIRIA to business customers.

1. Publisher and scope

Decktype is published by KAIRIA, the French SAS identified in the legal notice. These terms govern the website, Decktype account, cloud services, managed features and paid subscriptions. The free local application can be used without an account; third-party software and components remain subject to their own licences.

By creating an account or using a cloud service, you accept the applicable use rules. A paid subscription is formed only after the plan, price, billing interval and applicable taxes are shown and you expressly accept the terms in Stripe Checkout.

2. Business-only paid offer

Pro and Autonomous subscriptions are available only to natural or legal persons acting for the needs of their trade, business or profession. The subscriber confirms that they have legal capacity and, where relevant, authority to bind their organization.

These professional subscriptions do not carry the fourteen-day consumer withdrawal right or consumer mediation process. If a mandatory rule applies despite this eligibility requirement, it prevails only to its mandatory extent.

3. Account and security

  • You provide accurate information, maintain access to your email address and protect your sessions, devices and share links.
  • Each user uses their own account. Workspace administrators manage their organization’s members, roles and content.
  • You promptly notify KAIRIA of unauthorized access and revoke affected sessions, devices or shares where controls are available.

4. Plans, prices and payment

Included features and the current price are displayed before purchase. Paid subscriptions recur for the displayed interval, generally monthly, and renew automatically until cancelled. Amounts are charged in the displayed currency, with taxes determined from the billing information.

Stripe collects payment and provides invoices. After a payment failure, access may remain in a temporary grace state before being limited or suspended. Unless required by law or correcting an error caused by KAIRIA, a started billing period is non-refundable.

5. Cancellation and plan changes

You can manage or cancel the subscription through the billing portal linked from the account. Cancellation takes effect at the end of the paid period unless Stripe displays otherwise. Paid entitlements remain available until that date.

A plan change may cause a proration displayed by Stripe. Ending a subscription does not automatically delete the account or cloud content; deletion follows the product controls and privacy policy.

6. Content and acceptable use

  • You retain your rights in decks, images, comments, themes and other content you provide. You grant KAIRIA the technical licence, limited to the service term and needs, required to host, convert, synchronize, share or send it to the provider you request.
  • You warrant that you hold the rights, legal bases and permissions needed for personal data, trademarks, images, fonts, captured websites and third-party material.
  • Fraudulent access, bypassing limits, abusive automated extraction, malware, unlawful content and any use that harms another person’s rights or security are prohibited.
  • A share link may expose content to anyone who holds it. You are responsible for its duration, recipients and revocation.

7. Artificial intelligence

A managed feature sends content to OpenAI or Anthropic only at your request. You must review outputs before use or publication: they may be inaccurate, incomplete, similar to existing material or unsuitable for your context.

Do not submit sensitive data, secrets or regulated content without the appropriate authorization and assessment. Quotas, models and providers may change to maintain the service, without materially reducing an already paid period.

8. Availability, support and changes

KAIRIA uses reasonable efforts to provide and secure the service, without promising uninterrupted availability. Maintenance, incidents, third-party providers or force majeure may temporarily interrupt some or all cloud features.

KAIRIA may evolve the interface, limits and features. A material reduction to a paid plan is announced before it applies where reasonably possible. Support is provided according to the displayed plan and public contact details.

9. Intellectual property

KAIRIA and its licensors retain all rights in Decktype, its marks, interface, engine, bundled resources and documentation. No ownership is transferred. You may use the service for your professional needs while your access rights are active.

The .deck format is designed for portability; that portability grants no rights in Decktype or third-party elements included in a file.

10. Personal data and processing

KAIRIA acts as controller for account, security, commercial relationship and billing data. For personal data in content entrusted by your organization, your organization determines the purposes and generally acts as controller; KAIRIA processes the data on its instructions to supply hosting, synchronization, collaboration, sharing, support and requested AI features.

Processing lasts for the contract and the deletion and backup period described in the privacy policy. It may concern users, employees, customers, contacts, commenters and share recipients, and include their identifiers, professional contact details, contributions and any data that the customer places in a deck or asset.

  • KAIRIA processes that data only on documented instructions resulting from the contract and product use, and informs the customer if an instruction appears to breach applicable law.
  • KAIRIA limits access to people under confidentiality duties, applies appropriate technical and organizational safeguards, reports a breach to the customer without undue delay and reasonably assists with rights requests, impact assessments and security duties.
  • KAIRIA uses the subprocessors listed in the privacy policy. A material replacement is announced in advance where reasonably possible; the customer may raise a documented data-protection objection.
  • At the end of the service, KAIRIA deletes or returns data through available controls and subject to legal duties, while backup copies remain isolated until rotation. Available compliance information is supplied on reasonable request; any additional audit requires notice, confidentiality and payment of its costs by the customer.

11. Suspension and termination

KAIRIA may limit or suspend access for non-payment, security risk, unlawful use or material breach, preferring notice and time to cure where urgency permits. A serious or uncured breach may result in termination.

You may stop using the service and request account closure. Export content you wish to keep before deletion. Provisions that by nature should survive remain effective, including payment, ownership, confidentiality, liability and governing law.

12. Warranties and liability

The service is supplied with the reasonable care expected of a professional provider. You remain responsible for validating content, choosing recipients, keeping local backups and determining whether the service meets your professional obligations.

To the extent permitted by law, KAIRIA is not liable for indirect loss, loss of opportunity, revenue, reputation or data arising from a third-party provider or non-compliant use. KAIRIA’s total liability in any twelve-month period is capped at the fees excluding tax paid for the service during that period. This does not limit liability that cannot lawfully be excluded or capped, including gross or intentional fault.

13. Governing law and disputes

The contract is governed by French law. The parties seek an amicable resolution for thirty days after written notice of a dispute. Failing resolution, disputes between merchants are submitted to the competent courts for Versailles, subject to mandatory rules.

No consumer mediator is appointed because subscriptions are reserved for business customers. Complaints may be sent to contact@kairia.fr.

14. Changes to these terms

The version accepted in Checkout governs the order. KAIRIA may change the terms to evolve the service or comply with law. A material change affecting an active subscription is announced by email or in-product before it takes effect; you may cancel before the next renewal.
